Terms of Service

Please read these Terms and Conditions (“Terms”) carefully before using Kindow, the macOS application (“Application”) provided by Keyflowy LLC ("Keyflowy", "we", "our", or "us"). These Terms govern your use of the Application. By downloading, installing, or using the App, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, do not download, install, or use the App.

1. Definitions

• App: The Kindow macOS application, including any updates or modifications.
• License Key: A unique code provided by Kindow to activate and verify your license for the App.
• Updates: Any patches, improvements, or modifications to the App provided by Kindow.
• You: The individual or entity using the App.

2. License Grant

Kindow grants you a non-exclusive, non-transferable, revocable license to use the App in accordance with these Terms.

3. Internet Connectivity

Offline Functionality: The App is designed to work offline, except for the following scenarios:

• License Verification: The App may connect to Kindow's servers to verify the validity of your License Key.
• Updates: The App may check for and download updates to improve functionality or address security issues.

You acknowledge and agree that intermittent internet connectivity is required for these purposes.

4. Permitted Use and Restrictions

You agree to:

• Use the App in compliance with all applicable laws and regulations.
• Use the App only for its intended purpose of managing displays and windows.

You agree not to:

• License, rent, lease, sell, assign, transmit, outsource or distribute the App or the License Key.
• Reverse engineer, decompile, decrypt or disassemble the App, except as permitted by law.
• Attempt to bypass or disable any license verification mechanisms.
• Use the App in a manner that disrupts, damages, or interferes with Kindow's systems or servers.
• Use the application in violation of any applicable laws, including copyright laws.

5. Updates and Maintenance

Kindow may provide updates to improve functionality, address security issues, or comply with applicable laws. These updates may be required for continued use of the App, and failure to install them may impact functionality. Updates may be subject to additional terms and conditions, which will be provided at the time of installation.

6. Privacy and Data Usage

Kindow may collect and process minimal technical data necessary to verify your license and facilitate updates. This data may include your system version and App version. No personal data is collected or transmitted during offline use of the App. For more information, refer to our Privacy Policy.

7. Termination

These Terms remain effective until terminated by either you or Kindow. Kindow may terminate your license immediately without notice if you fail to comply with these Terms. Upon termination, you must cease using the App and delete all copies from your devices.

8. Limitation of Liability

To the maximum extent permitted by law: Kindow is not liable for any indirect, incidental, or consequential damages, including loss of data or business interruption, arising from your use of the App. Kindow's total liability for direct damages shall not exceed the amount you paid for the license.

Kindow may include third-party libraries or dependencies. Keyflowy LLC is not responsible for issues arising from such third-party components. Use of these components is governed by their respective terms.

9. Changes to These Terms

Keyflowy LLC reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting the updated Terms. Your continued use of the App constitutes acceptance of the revised Terms. If a revision is material we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
